3rd version of Subway tuna lawsuit filed

A revised lawsuit against Subway, the third version of the legal action, claims the brand's tuna isn't tuna, according to a Reuters report.

Plaintiffs Karen Dhanowa and Nilima Amin have filed a third version of a lawsuit against the sandwich giant in federal court in San Francisco. Previous lawsuits were dismissed.

This time, independent testing by a marine biologist of 20 tuna samples from Southern California Subways shows 19 of 20 had "no detectable tuna DNA sequences" while all 20 contained chicken DNA. Some samples showed cattle DNA and others contained pork,according to the news report. The complaint alleges Subway "duped" customers into paying for what they believed to be 100% tuna.

Subway, in response, said it will seek dismissal of the lawsuit, claiming its tuna is "high-quality, wild-caught 100% tuna." The company has launched a website and commercials in response to the lawsuits defending its trademark tuna sandwiches.
