Largest BK franchisee not participating in lawsuit

November 22, 2009

While a number of Burger King franchisees have joined a class action suit against the company over the chain's $1 Double Cheeseburger promotion, its largest franchise group has not.

Syracuse, N.Y.-based Carrols Restaurant Group, which owns 314 Burger King units in the Northeast and Midwest, is offering the burger promotion and seeing increased traffic, according to a story in The Buffalo News.

From The Buffalo News:
"We don't agree with the lawsuit," said Joseph Zirkman, vice president and chief counsel of Carrols. "We're not part of the National Franchisees Association, and they do tend to take positions we don't necessarily agree with." ...

Zirkman also said that he doesn't think a $1 double cheeseburger is really a money loser.

"It's a low-margin item," he said, "but it's not like you lose money every time you sell one."
