McDonald's to sue third party in cell phone photo suit

The Morning News (Fayetteville, Ark.): McDonald's Corp. has received permission to sue a third party in a lawsuit over nude pictures of a woman that ended up on the Internet. Last July, a customer left his cell phone at a Fayetteville, Ark., McDonald's. His wife then began receiving harrassing messages about photos of herself, which allegedly had been posted online by McDonald's employees along with her name, address and phone number.
 
The suit seeks $3 million for outrage, public disclosure of private facts and casting the couple in a false light. A Washington County Circuit judge granted McDonald's motion to sue Cody Hess, saying Hess was the cause of any damages the couple may have suffered. They also want any fault or damages pro-rated, based on liability.
