Minnesota restaurant sues McDonald's over slogan

A popular hamburger restaurant in Eden Prairie, Minn., is suing McDonald's for trademark infringement, according to a story in the Shakopee Valley News. The owners of Lions Tap claim McDonald's stole their slogan "Who's Your Patty?" in a lawsuit filed in federal court Aug. 28.
Co-owner Bonnie Notermann noticed McDonald's was using the saying in advertising for Angus burgers a few weeks ago and sent a letter to the company asking it to stop.
Lions Tap has a patent on the phrase in Minnesota and has filed a federal patent application.The phrase is on T-shirts the restaurant sells and also is used on its Web site and advertising.
McDonald's did not provide Shakopee Valley News with a statement.
