Subway sues Las Vegas restaurant for trademark infringement

Doctor's Associates Inc., franchisor of Subway, has filed suit in Nevada against Las Vegas pizza and sandwich shop Subway Avenue for trademark infringement. The suit also charges the shop's use of the Subway name and its menu results in unfair competition and that its Web site, www.subwayavenue.com, is an example of cybersquatting.The suit explains that the owner, Gevork Boyadzhyan, was sent a cease and desist letter in August and failed to comply.
 
An article in the Las Vegas Sun reports that the owner has changed the name of his shop to Sub Avenue.
 
The restaurant continues to use Subway in its Web site domain name, but the menu on the site does not refer to the name Subway Avenue or Sub Avenue. The restaurant's menu includes pizza, sub sandwiches, burgers, fried chicken and fish, and breakfast.
