Burger King, Popeyes, Tim Hortons to delete 'no-poach' provisions

March 3, 2020

Attorneys general in a dozen states and the District of Columbia said this week that QSR brands Burger King, Popeyes and Tim Hortons will no longer include language in their franchise agreements that bars franchisees from hiring another franchisee's employees as the result of investigations across the 13 jurisdictions, according to Reuters.

Both the Massachussets and California attorneys general announced that they and AGs in 11 other jurisdictions came to an agreement with the QSR companies following letters about the legal concerns with the provisions sent to the three brands in 2018.

Numerous other QSRs, like Sonic and Little Caesars, have previously agreed to strike similar so-called "no-poach" provisions from their franchisees' documents, following attorneys general investigations nationally.
