Although Burger King leadership admits no wrongdoing, it has announced that it is paying members of a class action suit submitted to the courts in October. Customers of the QSR who bought two or more Croissan-wiches there between Oct. 1, 2015 and May 19, 2017 with a BOGO coupon are eligible to get either $5 in cash or a $2 gift card from the company, according to the website,topclassactions.com.
To receive the compensation, however, the customer had to be one of those who used one of the brand's Crossan'wich BOGO coupons and ended up being charged the higher price of a Croissan'wich with meat, egg or cheese even when they ordered sandwiches without meat, egg or cheese. The settlement and original suit resulted from a complaint filed by Plaintiff Koleta Anderson, alleging those transactions violated consumer protection laws in three states.
Although the court did not assign liability in the suit, Burger King said it opted to settle to avoid further cost and disruption by the case. The brand's leadership said fewer than 10 percent of coupon orders may have been affected.
The approved settlement stipulates payment of $5 to affected customers, who have receipts, and the $2 gift cards will go to those who do not have receipts. Burger King said it has since updated its POS and put in new procedures to avoid future errors.
