Taco Bell wins bid to use 'Taco Tuesday' phrase in marketing

Taco Bell has won its bid against Taco John's to use the phrase "Taco Tuesday." Previously, Taco John's held the trademark for the phrase, according to a New York Post report.

Taco Bella sought to fight the ability to use Taco Tuesday in its marketing and petitioned the US Patent and Trademark Office to cancel the trademark in May. Taco John's chose not the fight the move, and instead donated $100 per unit to a nonprofit for restaurant workers in crisis. Taco John's has asked Taco Bell to do the same for its nearly 7,200 U.S. locations.

"We've always prided ourselves on being the home of Taco Tuesday, but paying millions of dollars to lawyers to defend our mark just doesn't feel like the right thing to do," Jim Creel, Taco John's CEO, said in a statement.
